Those affected by the Philatelic Forum scam may begin to compensate for the losses they have suffered in the 2022 Income Statement.
So far, those affected have not been able to deduct their personal income tax losses because they had to wait for the bankruptcy to end. But now, the Commercial Court number 7 of Madrid issued a ruling on July 31, 2022, after 16 years of process, ending the contest, and therefore giving fiscal firmness to the losses that have originated.
As we said, those affected can now begin to deduct the losses in the 2022 declaration, which is prepared from April 11 to June 30, 2023.
The Tax Administration establishes that, in the event of bankruptcy, the amount of the non-recoverable loss will only constitute a patrimonial loss in the year in which the impossibility of collecting is justified and this justification requires that all legal means have been exhausted.
To make the exact calculation, it will be necessary to prove the investment made and subtract the amount that has been recovered.
