This is what Social Security is doing, in fact, which, since October, no longer withholds tax from mothers or fathers. Although the Ministry of Finance insists on waiting for the official interpretation of the General Directorate of Taxes, the criteria seems clear.

Almost two months have passed since the ruling that working women do not have to pay taxes on maternity benefits. These have been intense weeks of work in which IT specialists have designed a "powerful system" that would allow the calculation of refunds in the most accurate way. "We want to ensure that no mistakes will be made and that everything is correctly calculated," say sources familiar with the process that has been carried out at the AEAT since October to avoid "a fiasco that would be poorly received by society."

And as the general secretary of the union of Technicians of the Ministry of Finance (Gestha), José María Mollinedo, explains, it is a "complex calculation" that is not limited exclusively to the elimination of the IRPF withholding, but must take into account the type of taxpayer and their particular characteristics in everything that affects deductions for investments, pension plans, donations, investments in housing... and others linked to the tax base.

"The AEAT is in no hurry to launch the programme that will facilitate online claims because taxpayers still have seven months until the deadline expires and there is more than enough time," says Mollinedo. It should be noted that claims for the 2014 financial year, the first to expire, can still be made until 30 June 2019.

Claims for the 2014 financial year will be the first to expire, and claims must be made before June 30, 2019.

However, the secretary general of Gestha predicts that the form could be available as early as next week. The director of the Tax Agency, Jesús Gascón, stated just a few days ago that the idea is to start “immediately” with the return of personal income tax and announced that the AEAT is “very close” to starting the mechanism for requesting the return of the tax on its website, after having considered the phase of receiving and framing data from Social Security and the tax authority to be “overcome”. Sources at the Treasury completely rule out the possibility that the returns will be delayed until next year and also point to “the next few weeks”.

As Minister María Jesús Montero announced and confirmed by those who have had access to the lists sent by Social Security to the Tax Agency, the Treasury has already set aside 1.2 billion euros to deal with these refunds. The Government is preparing the ground for the flood of claims that is coming, not only in economic terms, but also in the design of a communication strategy of "maximum diffusion", to inform taxpayers as soon as the procedure is activated.

The Government's estimates of the number of taxpayers who will benefit from the exemption are overstated

Gestha, however, throws cold water on the minister's estimates and estimates that less than 200,000 mothers and fathers will receive around 266 million euros from the withholdings made by the Treasury since 2014. The explanation? That the 83% of working mothers receive salaries of less than 18,400 euros per year. And as companies calculate the withholdings on the income they actually expect to pay in those eight months, the amount is reduced to 12,300 euros, an amount from which, in general terms, no withholdings are made. Thus, of the 1,100,000 people who a priori could benefit from the exemption from personal income tax on leave for having children, the technicians warn that around 900,000 will not receive any refund.

[/et_pb_text][/et_pb_column][/et_pb_row][/et_pb_section]

The Tax Agency has the data on the men and women whose tax has been withheld since 2014 and the budget allocation to satisfy the claims.
