However, the Executive refuses to make an assessment for the moment and postpones it until the beginning of next year. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">However, the Minister of Labour, Magdalena Valerio, did hint in a recent statement that &quot;possibly&quot; the reduction in the number of overtime hours reflected in the latest Active Population Survey (EPA) - the first to account for a full quarter since its launch - is a consequence of this new obligation on the part of employers to control the time of entry and exit of workers, which has as its main objective to bring to light the huge amount of overtime that employees do without, in many cases, receiving anything in return.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">In the third quarter of the year, almost 630,000 fewer hours of overtime were worked per week than in the previous quarter, reaching 5.39 million, the lowest level in the last two years and half of the number worked before the crisis, when at the beginning of 2008 the figure exceeded 10 million. In addition, this is now three consecutive quarters of year-on-year decline. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">But what is even more striking is the sharp drop in unpaid overtime, to the point that it is the largest in the entire historical series, which begins in 2008. Thus, of those almost 5.4 million extra hours recorded, a total of 2.22 million \u2013 which is four out of ten \u2013 were neither paid, nor paid into Social Security nor taxed, which causes a significant loss to the State coffers. This represents a reduction of 23.71% compared to the previous quarter and, although it is true that traditionally they are reduced in the third quarter of the year, this is the largest decrease since records began and places them at levels never seen before with a specific exception in 2010, when in the midst of the economic crisis they also stood at 2.2 million.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">On the other hand, paid overtime hours have risen slightly to over 3.17 million per week, which represents an increase of 2%, which is more valuable because it is normal for them to decrease in summer.<\/span><\/p>\n<h2 style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Opposing positions<\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">\u00abCompanies are already regulating themselves\u00bb, explained Valerio, although she was cautious in confirming a cause-effect relationship between the drop in overtime in this last quarter and the time recording and maintained that it is still too early to make a formal assessment. The employers&#039; association is very clear about this, however, and believes that \u00abeverything is due to the economic slowdown and has nothing to do with the implementation of the time recording\u00bb. The director of Employment of the CEOE, Rosa Santos, stated to this newspaper that it is \u00abcertainly due to the slowdown in the economy\u00bb, which is causing \u00abless activity\u00bb. In her opinion, the majority of companies were already complying with the agreed hours and she maintains that this measure \u00abwould have been more effective\u00bb if it had been directed at the companies or sectors that did not comply, and not in a generalised way.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Ana Ercoreca, president of the Labour Inspectors&#039; Union, disagrees with this opinion. She does believe that there is a direct relationship between the sharp decrease in overtime and the entry into force of the workday register. &quot;I think it is being effective because it has challenged both companies and workers,&quot; she says, in line with UGT, which argues that the data from the latest EPA &quot;confirms the importance of the law on time control against labour fraud,&quot; which has a high cost for the country, since workers lose 2.3 billion euros a year and in turn the Social Security stops paying contributions of around 650 million. The union points out that, if these overtime hours were not performed, 180,000 full-time jobs could be created.<\/span><\/p>\n<blockquote>\n<p style=\"text-align: justify;\">S<strong><em>According to CCOO, &quot;the fact that the measure exists is having a positive impact&quot; as it enables workers to claim for excess hours, &quot;something that was not possible before&quot;<\/em><\/strong><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">CC OO also believes that &quot;the fact that the measure exists is having a positive impact&quot; as it enables workers to claim for excess hours, &quot;something that was not possible before.&quot; However, Mari Cruz Vicente, secretary of Trade Union Action for the organization, stresses that &quot;not enough progress has been made&quot; in the implementation of the work record and there are &quot;few&quot; open negotiation processes, although she does recognize that &quot;some control mechanism has been established.&quot;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The employers&#039; association, however, assures that the majority of the regulations are being complied with.
