{"id":120198,"date":"2020-06-02T10:29:42","date_gmt":"2020-06-02T08:29:42","guid":{"rendered":"https:\/\/aseryde.com\/?p=120198"},"modified":"2020-06-11T10:30:38","modified_gmt":"2020-06-11T08:30:38","slug":"aprobado-el-ingreso-minimo-vital","status":"publish","type":"post","link":"https:\/\/aseryde.com\/en\/aprobado-el-ingreso-minimo-vital\/","title":{"rendered":"Approved the minimum vital income"},"content":{"rendered":"[et_pb_section fb_built=\u00bb1\u2033 _builder_version=\u00bb3.20.2\u2033][et_pb_row _builder_version=\u00bb3.20.2\u2033][et_pb_column type=\u00bb4_4\u2033 _builder_version=\u00bb3.20.2\u2033][et_pb_text _builder_version=\u00bb3.20.2\u2033]<blockquote>\n<h2 style=\"text-align: justify;\">This is a non-contributory Social Security benefit.<\/h2>\n<\/blockquote>\n<p style=\"text-align: justify;\">Through Royal Decree-Law 20\/2020, of May 29, published in the BOE of June 1 and coming into force on the same day of its publication, a new non-contributory Social Security benefit is created: the minimum income vital), with the aim of preventing the risk of poverty and social exclusion of people who live alone or integrated into a coexistence unit, when they are in a situation of vulnerability due to lacking sufficient economic resources to cover their basic needs. .<\/p>\n<p style=\"text-align: justify;\">It is a subjective right to a benefit of an economic nature compatible with the aid that the autonomous communities may establish and characterized by guaranteeing a minimum level of income, protecting in a differentiated way depending on whether it is directed to an individual beneficiary or a cohabitation unit, extending while the situation of vulnerability persists, allow the transition from a situation of exclusion to one of participation in society and be non-transferable except in the cases and with the limits provided for in article 44 of the LGSS, that is, for compliance with the alimony obligations in favor of the spouse and children or in the case of obligations contracted by the beneficiary within Social Security.<\/p>\n<h3 style=\"text-align: justify;\">Requirements required to receive the IMV<\/h3>\n<p style=\"text-align: justify;\">In order to receive the IMV, the requirements established in the RDL must be met to be a beneficiary, be the holder of the IMV, access the benefit and maintain your receipt.<\/p>\n<p style=\"text-align: justify;\">Regarding the requirements to be a beneficiary of the IMV, the following are established:<\/p>\n<p style=\"text-align: justify;\">1. Be members of a coexistence unit<br \/> 2. Be at least 23 years old and under 65.<br \/> 3. Living alone or sharing a home with a cohabitation unit of those contemplated in the previous section, when they are not integrated into it, provided that the following circumstances occur:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Not be united to another by marriage or as a de facto couple in the terms defined in the LGSS, except for those who have initiated separation or divorce proceedings or those who are in other circumstances that can be determined by regulation, to whom will require compliance with this circumstance.<\/li>\n<li>Not be part of another cohabitation unit.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Users of a residential service provision, of a social, health or socio-health nature, on a permanent basis and financed with public funds, may not be beneficiaries, except in the case of women victims of gender violence or victims of trafficking in human beings and sexual exploitation, making a new referral to future regulatory regulations for these cases.<\/p>\n<h3 style=\"text-align: justify;\">Requirements to be the holder of the IMV<\/h3>\n<p style=\"text-align: justify;\">Ownership will fall on those people who have full capacity to act, and they will be responsible for the IMV application (although it must be signed by all members of the cohabitation unit of legal age who are not legally incapacitated) and its receipt (although it is summoned to a future regulatory development the possibility of paying the benefit to another member of the cohabitation unit), in their own name or on behalf of a cohabitation unit whom they represent.<\/p>\n<p style=\"text-align: justify;\">But, in addition, they must be of a certain age depending on whether or not they are integrated into a cohabitation unit:<\/p>\n<ul>\n<li style=\"text-align: justify;\">For those who are integrated into a cohabitation unit, it is required that they have a minimum age of 23 years, or be over 18 years of age or an emancipated minor in the case of having children or minors in custody for the purposes of adoption or permanent family fostering. and be under 65 years of age unless the cohabitation unit is made up only of people over 65 years of age and minors or judicially incapacitated persons, in which case the holder will be the person over 65 years of age who requests the benefit.<\/li>\n<li style=\"text-align: justify;\">For those who are not integrated into a cohabitation unit, the minimum age will be 23 years or of legal age if they are women victims of gender violence or victims of human trafficking and sexual exploitation.<\/li>\n<li style=\"text-align: justify;\">In those cases in which there are several people in a cohabitation unit who could hold such a condition, the owner will be the person who is recognized with the benefit requested on behalf of the cohabitation unit.<\/li>\n<li style=\"text-align: justify;\">Finally, it is noted that there may be a maximum of 2 owners in the same address.<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\">Requirements to access the benefit<\/h3>\n<p style=\"text-align: justify;\">For these purposes, the RDL requires compliance with the following requirements, both at the time of submission of the application, or at the time of requesting its review, and during the time of collection of the IMV:<\/p>\n<p style=\"text-align: justify;\">The requirements to be met by all beneficiaries, whether or not they are integrated into a cohabitation unit, are:<\/p>\n<p style=\"text-align: justify;\">1. Have legal and effective residence in Spain<br \/> 2. Being in a situation of economic vulnerability due to lack of sufficient income, income or assets.<br \/> 3. Have requested the current pensions and benefits to which they may be entitled.<br \/> 4. If they are not working and are of legal age or emancipated minors, be registered as job seekers, except in cases determined by regulation.<\/p>\n<p style=\"text-align: justify;\">In addition, a series of specific requirements are established for people between 23 and 65 years old who live alone, or who share a home with a cohabitation unit and are not integrated into it, as well as for those who are part of a cohabitation unit.<\/p>\n<p style=\"text-align: justify;\">Finally, the RD establishes a series of requirements to maintain the receipt of the benefit.<\/p>\n<p style=\"text-align: justify;\">Regarding the amount, the amount of the IMV will be determined by the difference between the amount of the guaranteed income and the set of all the income and income of the beneficiary or of the members of the cohabitation unit from the previous year.<\/p>\n<p> The benefit will be maintained as long as the reasons that gave rise to its granting subsist and the requirements and obligations provided for in the RDL are met.<\/p>\n<p style=\"text-align: justify;\"> The financial benefit will preferably be requested at the Social Security electronic headquarters or through other telematic communication channels that the INSS has enabled for this purpose.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]","protected":false},"excerpt":{"rendered":"<p>This is a non-contributory Social Security benefit.
