With this decision, agreed last Tuesday with the social agents after tough negotiation sessions, the Executive not only extends the coverage periods of this aid - which is estimated to reach 7,000 million euros: 5,000 million for the ERTE and 2,000 million for the self-employed\u2015, but adds a series of modifications with which to try to expand the group of beneficiaries.<\/p>\n<h3 style=\"text-align: justify;\">Is there any change in the definition of ERTE?<\/h3>\n<p style=\"text-align: justify;\">No. This new extension maintains the same protection schemes that were included in the previous royal decree that expired on January 31, so the three types of ERTE that have been applied until today will remain in force: those intended for ultra-protected sectors. (in which are concentrated those companies that have recovered less than 65% of their workers from ERTE and maintain more than 15% of affiliates in a given activity) and companies linked to their value chain; the ERTE of impediment of activity and the ERTE of limitation. The latter two are designed for temporary administrative restrictions such as reducing capacity or prohibiting the opening of some businesses (for example, nightclubs).<\/p>\n<h3 style=\"text-align: justify;\">What type of benefits does the new standard include?<\/h3>\n<p style=\"text-align: justify;\">Depending on the type of ERTE, the exemptions change. In the case of ultra-protected sectors and their value chains, the exemptions will be from 85% for companies with fewer than 50 workers and 75% for those with more than 50 employees (whether they have been reinstated or remain suspended). In ERTE due to disability - companies from any sector or activity can apply for this modality - the exemptions will be 100% for those with less than 50 workers and 90% for those that do not reach this figure. For the limitation ERTE \u2013 any type of company can also apply \u2013 the exemptions will be progressively reduced until the month of May. In those with more than 50 employees they will be 100% in February, 90% in March, 85% in April and 80% in May. For the others, they will become 90% for the first month, and in the following months 80%, 75% and 70%.<\/p>\n<h3 style=\"text-align: justify;\">What happens if a company is already immersed in an ERTE prior to this extension?<\/h3>\n<p style=\"text-align: justify;\">Nothing. In fact, the adaptation process to these new formulas will be carried out automatically. Companies that are holders of an ERTE due to an impediment or limitation that has been authorized before or during the validity of the new rule will not have to request a new process before the labor authority. They will only have to send a communication to both this authority and the union representation of the company&#039;s workers. ERTE that are based on economic, technical, organizational and production causes may process an extension, also adhering to these two conditions.<\/p>\n<h3 style=\"text-align: justify;\">Is the commitment maintained not to lay off companies that have applied for an ERTE in the six months following?<\/h3>\n<p style=\"text-align: justify;\">Yes. In fact, this was one of the points that paralyzed the agreement to extend the deadlines for a few weeks, since the Spanish Confederation of Business Organizations (CEOE) and Cepyme, the employers&#039; association of small and medium-sized companies, were looking for flexibility of this rule that was not finally agreed upon.<\/p>\n<p style=\"text-align: justify;\">Likewise, workers affected by an ERTE will continue to have access to the benefit - which will be equivalent to 70% of the regulatory base -, without a waiting period, and the period consumed until January 2022 will not be counted in their contributions.<\/p>\n<h3 style=\"text-align: justify;\">Has aid to the self-employed changed?<\/h3>\n<p style=\"text-align: justify;\">Not in its definition, but in its amount.
