The Supreme Court, however, confirms that article 10.1 LRJS grants the worker a <\/span><b>elective jurisdiction<\/b><span style=\"font-weight: 400;\">: You can sue in the place where you actually provide your services (your domicile) or in the company&#039;s jurisdiction, so the choice of Madrid was fully valid.<\/span><span style=\"font-weight: 400;\"><br \/><br \/><\/span><\/p>\n<h3><strong>The Supreme Court&#039;s key arguments<\/strong><\/h3>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Elective territorial jurisdiction (art. 10.1 LRJS)<\/b><b><br \/><\/b><span style=\"font-weight: 400;\"> The law gives the plaintiff two options: courts in the place where services were provided or courts in the place where the defendant resides. &quot;Place of provision&quot; is not the address shown in the contract, but <\/span><b>where the work is carried out in practice<\/b><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"><br \/><br \/><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Teleworking as an \u201ceffective place\u201d<\/b><b><br \/><\/b><span style=\"font-weight: 400;\"> The Remote Work Act (LTD, Act 10\/2021) requires the point from which work will be agreed upon. If that point is the employee&#039;s home, that is <\/span><b>your workplace<\/b><span style=\"font-weight: 400;\"> for judicial purposes.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Additional provision 3 of the LTD \u2013 invoked by the company \u2013 establishes criteria only \u201cfor administrative purposes,\u201d not procedural ones.<\/span><span style=\"font-weight: 400;\"><br \/><br \/><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Right to effective judicial protection (art. 24 CE)<\/b><b><br \/><\/b><span style=\"font-weight: 400;\"> Forcing teleworkers to litigate hundreds of kilometers away would violate the protective purpose of the LRJS. The Supreme Court recalls that teleworking is voluntary for both parties and that the employer <\/span><b>assumes<\/b><span style=\"font-weight: 400;\"> that consequence when signing.<\/span><span style=\"font-weight: 400;\"><br \/><br \/><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Hybrid model<\/b><b><br \/><\/b><span style=\"font-weight: 400;\"> If the employee alternates home and office, he\/she may file a claim in:<\/span><span style=\"font-weight: 400;\"><br \/><\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Your address (place of partial service).<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The physical center if the defendant can be summoned there.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The company&#039;s address.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> This is provided for in the second paragraph of article 10 of the LRJS.<\/span><span style=\"font-weight: 400;\"><br \/><br \/><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<h3><strong>Practical implications<\/strong><\/h3>\n<p><span style=\"font-weight: 400;\">For the <\/span><b>working person<\/b><span style=\"font-weight: 400;\">The Supreme Court&#039;s doctrine offers a clear advantage: you can file the lawsuit in the court of your own city, avoiding costly travel and a potential financial obstacle when defending your rights. Furthermore, it strengthens legal certainty for those who provide their services fully or partially from home, by unequivocally recognizing that their home is also their place of work for procedural purposes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For the <\/span><b>company<\/b><span style=\"font-weight: 400;\">However, the resolution assumes that any dispute arising from a teleworking contract may be brought before the courts of the employee&#039;s location. Therefore, it is advisable to review remote work agreements, assess this territorial risk in the procedural strategy, and ensure that you have legal resources capable of acting in the different locations where your teleworkers reside.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, the ruling opens the door to transferring this interpretation to <\/span><b>other labor actions<\/b><span style=\"font-weight: 400;\"> (salary claims, professional classification, etc.) when employment is carried out entirely from home.<\/span><\/p>\n<h3><strong>Upcoming challenges<\/strong><\/h3>\n<p><span style=\"font-weight: 400;\">The doctrine affects thousands of &quot;full remote&quot; contracts signed after the pandemic and highlights other questions that still have no unanimous answer, such as:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Applicable holidays<\/b><span style=\"font-weight: 400;\"> to the teleworker who resides in a different community.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Work inspection<\/b><span style=\"font-weight: 400;\"> and time recording in private homes.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">For now, the Supreme Court sends a clear message: <\/span><b>The address where the laptop is turned on also counts as a workplace in court.<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>In its ruling of April 24, 2025, the Supreme Court clarified that, when an employee provides services remotely from home, the &quot;place of work&quot; for procedural purposes is that address.
