The High Court has been clear: it is not enough to simply pay the salary or list its components; companies must explain how each item on the payslip was calculated.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The case arose from a class-action lawsuit filed by the ALFERRO union against the Renfe Group. The collective dispute affected approximately 13,000 employees of various professional categories within the Renfe Group workforce.<\/span> <span style=\"font-weight: 400;\">Renfe appealed to the Supreme Court, but the ruling confirmed what the National Court had already established: its payrolls were not sufficiently clear.<\/span><\/p>\n<h2>&nbsp;<\/h2>\n<h3><b>What changes from now on<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Until now, many companies believed they were complying with the law simply by including compensation items on the payroll. The Supreme Court says that&#039;s no longer enough.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The judges are making a substantive, rather than a formal, interpretation of Article 29.1 of the Workers&#039; Statute. Simply listing items or using the official template is insufficient. It is essential to detail calculations, explain accrual bases, and indicate the corresponding periods.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Specifically, the Court detected three common problems in the payroll model analyzed:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In the <\/span><b>arrears<\/b><span style=\"font-weight: 400;\">It was not specified to which period the paid days corresponded.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In the <\/span><b>concepts of accrual exceeding one month<\/b><span style=\"font-weight: 400;\">It was not indicated whether the payment was in full or partial due to absences, strikes or other incidents.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In the <\/span><b>supplements by day or hour<\/b><span style=\"font-weight: 400;\">Only the key and the amount were collected, without explaining the unit of calculation.<\/span><\/li>\n<\/ul>\n<h2>&nbsp;<\/h2>\n<h3><b>Who is affected?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">This ruling has a direct impact on <\/span><b>all companies with employees<\/b><span style=\"font-weight: 400;\">but especially in those with:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Variable compensation or functional supplements<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Workers with temporary disabilities (sick leave or accident leave)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Outstanding salary arrears or adjustments<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Irregular working hours, reductions or extensions<\/span><\/li>\n<\/ul>\n<h3><b><br><\/b><\/h3><h3><b>Why is this important for workers?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The payslip must provide the employee with enough information to understand how the amounts being paid have been calculated, without requiring any additional consultations or calculations.<\/span><a href=\"https:\/\/www.ayudalaboral.net\/trabajo\/5140-obligacion-claridad-transparencia-nominas\"><span style=\"font-weight: 400;\">&nbsp;<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400;\">The Supreme Court expressly rejects the notion that the employee should have to perform the calculations themselves. It rejects the possibility of shifting the burden of reconstructing their salary calculation onto the employee using data external to the payslip, considering this incompatible with the principle of transparency and the diligence required of the employer.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, the existence of computer applications for the employee to check incidents does not exempt the company from its obligation to provide clear and detailed pay slips from the beginning, since that implies transferring to him the responsibility of requesting clarifications.<\/span><a href=\"https:\/\/www.ayudalaboral.net\/trabajo\/5140-obligacion-claridad-transparencia-nominas\"><span style=\"font-weight: 400;\">&nbsp;<\/span><\/a><\/p>\n<h2>&nbsp;<\/h2>\n<h3><b>What should companies do now?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Companies should review their payroll models and ensure they include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">He <\/span><b>period to which it corresponds<\/b><span style=\"font-weight: 400;\"> each variable concept or delay<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>days actually paid<\/b><span style=\"font-weight: 400;\"> when the amount depends on presence or activity<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>percentages or bases<\/b><span style=\"font-weight: 400;\"> applied to calculate complements<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>incidents<\/b><span style=\"font-weight: 400;\"> that have reduced or modified the accrual (IT, strike, unpaid leave, sanctions\u2026)<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Payroll management cannot be treated as just another administrative task.
