The Ministry of Employment and Social Security has approved a <a href=\"http:\/\/aseryde.com\/wp-content\/uploads\/2016\/09\/BOE-A-2016-8361.pdf\" target=\"_blank\">ministerial order that was published on September 12 in the Official State Gazette (BOE)<\/a> which permanently eliminates this guest book, both in paper and electronic format.<br \/>\nThis measure will result in savings of 700 million euros, which is part of the Government&#039;s measures to reduce administrative burdens, as explained yesterday by the Ministry of Employment.<\/p>\n<h2><strong>The documentary obligation ceases to belong to the company<\/strong><\/h2>\n<p style=\"text-align: justify;\">This elimination also transfers from the company to the Labor and Social Security Inspectorate the obligation to document and record the inspection actions carried out during visits to the companies or in their appearances at the inspection offices.<br \/>\nIn 2013, this book was replaced by the electronic format, in a first adaptation of the Labor Inspectorate due to the increasing use of new technologies in the relations of companies with the Administration.<br \/>\nNow, labor inspectors, when they make visits to work centers or checks in public agencies, will extend diligence, as established in the order, and may use electronic means.<br \/>\nSpecifically, they will issue a diligence for each visit, reflecting the matters, aspects examined or incidents, which must be kept for a period of five years.<br \/>\nThe order itself regulates the action diligence model of the Labor and Social Security Inspectorate, the use of which becomes effective from the day following its publication in the Official State Gazette (BOE), that is, 13 December. September 2016.<\/p>\n<h2><strong>The inspections will continue, and the obligation to collaborate will remain the same<\/strong><\/h2>\n<p style=\"text-align: justify;\">All employers and workers are aware of the obligation to duly attend to Labor and Social Security Inspectors and Labor Sub-inspectors, proving their identity, collaborating with them on visits or other inspection actions.<br \/>\nWe must remember, as Order ESS\/1452\/2016 itself does, that Law 14\/2013, of September 27, on support for entrepreneurs and their internationalization, eliminates the obligation for companies to have, in each center of work, a guest book available to the officials of the Labor and Social Security Inspectorate. Instead, it reflects that it must be the Labor Inspectorate that is in charge of maintaining this information from the electronic visitor book developed by the Central Authority of Labor and Social Security Inspection; However, the Agreement of the Council of Ministers, of July 10, 2015, proposes the suppression of the obligatory nature of the electronic guest book for 2017, so we will have to see if it is finally produced effectively.<br \/>\nTaking into account that the Ministry of Employment and Social Security itself establishes that, although electronic means are used as far as possible, the interested parties are not imposed obligations when acquiring or completing any kind of books or forms to collect these proceedings, the model presented may be used with the established contents or a substitute official document.<\/p>\n<p style=\"text-align: justify;\"><strong>Content of the new diligence model<\/strong><br \/>\nThe content of the new Proceedings model is regulated in article 2 of the Order initially referred to, and basically establishes the obligation to contain:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Place and date of issuance of the diligence.<\/li>\n<li>Identification of the acting official and body to which he belongs.<\/li>\n<li>Data of the company and work center.<\/li>\n<li>Name, surnames and DNI\/NIE of the person who attends\/appears before the official.<\/li>\n<li>Subjects or aspects examined and other concurrent circumstances.<\/li>\n<li>Others depending on the object of the diligence.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">As indicated in Order ESS\/1452\/2016, this diligence model may also be used for the rectification requirements that the technicians authorized in Occupational Risk Prevention carry out in the exercise of their verification functions.<br \/>\nWe must point out that &quot;each copy of the diligence delivered or sent to the company must be kept at the disposal of the Labor and Social Security Inspectorate for a period of five years, counting from the date of issuance of each one of them&quot; .<br \/>\nThe Guest Books and Proceedings models prior to the Order studied here must also be kept during this period of time.<\/p>\n<p style=\"text-align: justify;\">For any query that has to do with the situation of your workers, or the formalities that must be fulfilled before the different public bodies, do not hesitate to <a href=\"http:\/\/aseryde.com\/en\/contacto-cieza\/\" target=\"_blank\">Consult<\/a> to our employment experts.
