Finally, when do I have to file my corporate tax return?
The Administration has given a deadline until November 30, although with certain requirements and circumstances that, if not met, will lead to sanctions.
Public Administration procedures have also been affected by the crisis caused by Covid-19. This is what has happened with the deadline for procedures such as Corporate Tax (IS).
A new statement before December
Until now, in order to file a corporate tax return, a company had to have previously approved its annual accounts. However, due to the exceptional circumstances, this year it was allowed to file the self-assessment on 27 July without having previously approved the annual accounts.
If the company has not approved them on that date, due to circumstances arising from COVID-19, the filing of the Corporate Tax is allowed without this procedure. However, the process does not end there.
Those companies that did not approve their annual accounts before the end of July, as they were required to do, must resubmit the declaration before 30 November. To do so, in July they submitted the IS, but ticking the box indicating that the annual accounts had not been approved.
Supplementary self-assessment
The Administration has set a later date for the approval of the annual accounts. In this regard, the company will have until November 30 as the deadline. So once the accounts are approved, a new self-assessment must be submitted. The amount to be paid must also be taken into account, since depending on whether it is higher or lower, the self-assessment must be considered as complementary.
If the self-assessment has been submitted as a supplementary declaration, this must be indicated in each of the forms submitted. For example, in form 200, 'New declaration according to RDLey 19/2020' must be marked. In this case, it must also be indicated on the first page that it is a supplementary declaration and the supporting document number of the declaration made without having the accounts approved must be provided.
