Royal Decree 416/2026, published in the BOE on May 28, completely renews the rules of flexible retirement in Spain. From August 28, 2026, retirees will be able to combine their pension with work, even as self-employed individuals, under more advantageous conditions than before.

What is flexible retirement and what changes?

Flexible retirement is the option of receiving a retirement pension while continuing to work. Until now, it was a little-used option, partly because the conditions were not particularly attractive.

The new Royal Decree aims to facilitate the return of pensioners to the labor market after full retirement, without requiring them to forfeit a significant portion of their pension. To this end, Royal Decree 1132/2002, which had been in force for over two decades without a comprehensive review, is repealed in its entirety.

The standard It will come into effect on August 28, 2026, three months after its publication in the BOE.

 

The most important new features

1. The door is opened to the self-employed

The extension to self-employment is one of the central novelties of the reform, breaking with the previous configuration, which was exclusively linked to part-time salaried work.

However, there is one key requirement: the pensioner He/She cannot have been registered as self-employed in the previous three years upon retirement. If that condition is met, they may resume self-employment while simultaneously receiving up to 25% of your pension.

2. The minimum waiting period is eliminated.

Previously, you had to wait a certain period after retirement before you could apply for flexible retirement. With the new regulations, flexible retirement is no longer tied to any waiting period and can be requested at any time after the pension is granted.

3. New range of working hours for salaried employment

The working day compatible with pension benefits is now set between the 33% and the 80% with respect to the working hours of a comparable full-time worker. Within that range, the pension is reduced in inverse proportion to the reduction in working hours.

4. Bonus for returning after 6 months

As an incentive to return to the labor market, if the pensioner waits at least 6 months since his retirement Before returning to work, you receive an additional percentage of your pension:

  • Day between the 55% and 80%: increase of 25% regarding the compatible pension.
  • Day between the 33% and less than 55%: increase of 15% regarding the compatible pension.

 

Who is affected by this rule?

Retired workers

This is the most direct option for those who have already retired and want to return to the workforce part-time. They now have more flexibility in their working hours, better pension amounts, and the possibility of working as self-employed.

Retired self-employed workers

In the case of self-employment, the compatible pension will always be 25%. Although it is a limited percentage, it represents a significant change: until now this option did not exist within the flexible retirement scheme.

Companies and employers

Companies that hire pensioners under this arrangement must take into account that the worker maintains his pensioner status for the purposes of healthcare and social protection throughout the compatibility period.

People with involuntary early retirement

There is a particularly relevant improvement for those who retired early without having chosen it (due to dismissal, for example): when they return to full retirement from flexible retirement, they will see their initial pension improved by recalculating the regulatory base and the applicable percentage, according to the credited contribution period.

 

Who does it not apply to?

The new regulation affects all Social Security schemes, except to the special regimes of civil servants of the State, Armed Forces and personnel serving the Administration of Justice.

 

Things to keep in mind

Before applying for flexible retirement, it is advisable to carefully consider several things: the percentage of working hours you will be working, whether it is worth waiting those 6 months to receive the additional bonus, and whether the option is compatible with other benefits or supplements you are receiving.

Contributions made during the period of combined employment do not increase the pension, except in the case of involuntary early retirement. It is also important to know that no minimum pension supplements are granted during the combined employment period, although these are fully recovered once employment ceases.
