Social Security is monitoring the method used by self-employed workers to register, since legal times have changed.
Last year, some of the new regulations of the Self-Employed Workers Act came into force. One of them is directly related to the way in which self-employed professionals register. If they do not do so following the parameters established in the regulation, the professional is exposed to fines of 3,000 euros.
Previously, when a self-employed worker registered with the Treasury, he or she had 30 days to register with Social Security. However, the new regulation specifies that the registration of the self-employed professional with Social Security cannot be done after the start date of the activity (which is set by the Treasury).
Therefore, before starting the activity, you must register with Social Security and, subsequently, with the Treasury. After some time, it has been observed that Social Security is monitoring this issue, as an irregularity could be committed.
Therefore, if you registered as self-employed in 2018 or at the beginning of 2019, it is advisable to check the registration dates.
So, how do I register as self-employed in 2019?
Professionals who are going to register as self-employed this year must follow the following process:
- Register as self-employed with Social Security. As we have already mentioned, this step must be taken before anything else. At the latest, the day before starting the activity, you must be registered with Social Security. Otherwise, in addition to not being able to access benefits such as the flat rate, you may face sanctions.
- Registration with the Tax Office. This can be done through the electronic office, using form 036. This document must indicate the date of registration with Social Security, tax data, as well as the Activity Tax heading (depending on the activity). It is also necessary to indicate the address where the activity will be carried out, the start date of the activity, VAT regime and IRPF regime.
- In addition, self-employed workers must take into account each particular case, in case they need an opening license, notify the Employment Department, electronic visitors' book (LVO), etc.
In any case, it is best to leave the paperwork in the hands of professionals to avoid surprises. At Aseryde we can help you get your new business up and running. contact with us and we will inform you
