It will apply in the case of work accidents or occupational diseases.
The Official State Gazette has published a resolution (PDF of the resolution, HERE) which establishes the creation of a Social Assistance Reserve. The purpose of this action is to finance actions that the self-employed person has to carry out due to a consequence of an occupational contingency.
That is, due to a work accident that causes some kind of inconvenience that prevents you from continuing with your professional work after the accident. Among the measures, there are some specific ones for self-employed workers.
Adapt the premises where the self-employed person works
The benefit is entitled “Adaptation of the premises where the self-employed worker carries out his/her activity” and is aimed at helping the injured worker to cover the costs of removing barriers and adapting the workplace to the new needs arising from the work accident or occupational disease.
But who will provide these benefits?
The mutual societies that collaborate with Social Security will do so through the Special Benefits Commissions, which will process a file.
The file must include a report from the medical service of the collaborating mutual insurance company or from the corresponding social services, as well as a report of the work accident or occupational disease, the resolution of the managing entity or the final court ruling in which the professional nature of the contingency is clarified.
These organisations will therefore be the ones to determine the percentage of expenses that the self-employed professional will receive in order to help him/her cover them. Access to the complementary benefits, according to the BOE, will require the beneficiary to provide the invoices and/or documents showing the expenses destined for these purposes.
