RD-Law 15/2020 solves the situation of the self-employed without mutual insurance (benefit for cessation of activity)

One of the problems that were pending to be resolved when requesting the benefit for cessation of activity was for the self-employed who had not chosen a mutual insurance company.

RD-Law 15/2020 published today, April 22, in the BOE, solves this situation. Specifically, in the Disp. Eighth Final.

Royal Decree-Law 8/2020, of March 17, on extraordinary urgent measures to address the economic and social impact of COVID-19, is modified as follows:

Section 7 of article 17 is worded as follows: «7. The management of this benefit will be the responsibility of the mutual societies collaborating with Social Security or the Social Institute of the Navy.

The self-employed who have not exercised the option provided for in article 83.1.b) of the consolidated text of the LISOS (that is, choose a mutual insurance company), must, to be entitled to this benefit, submit the application to a mutual insurance company that collaborates with the Security Social.

This means that from that moment it will be understood that the self-employed person chooses that mutual insurance company with effect from the first day of the month in which the right to the extraordinary benefit for cessation of activity arises.

Along with the request for the benefit, they must formalize the corresponding membership with said mutual insurance company.

This will include coverage of professional contingencies, temporary disability due to common contingencies and the benefit of cessation of activity that until now had been covered with the National Social Security Institute (INSS) and with the State Public Employment Service (SEPE).

The General Treasury of Social Security will take account of these options based on the communications made by mutual collaborators regarding the recognition of extraordinary benefits or through any other procedure that may be established by the General Treasury of Social Security.
