The 2018 Income and Wealth campaign has started today and comes with important news, and it must be taken into account that, as usual, in general calculations, the Treasury will return more money than it will receive in this campaign because during last year taxpayers They had excessive withholdings or because the deductions or bonuses allow the payment of taxes to be reduced, and where an important part of this difference will be due to the Supreme Court ruling regarding the exemption of paternity and maternity benefits.

Who has to file the declaration?

In principle and in general, all taxpayers resident in Spain will have to submit the declaration, except those who have only received income from work, equal to or less than 22,000 euros per year, as long as it comes from a single payer.

When there are several payers (if you have had several jobs during the last year), as long as the sum of the rest does not exceed 1,500 euros.

Nor will they have to submit the declaration when the only income comes from retirement pensions, pension plans, group insurance, social security mutual societies, corporate social security plans, insured pension plans and long-term care insurance benefits. But provided that to set the personal income tax withholding it had been carried out in accordance with the established regulatory procedure (the taxpayer has to request it from the bank, insurance company or Social Security).

The limit for not having to file the declaration is reduced to 12,643 euros per year when the taxpayer has had more than one payer and the sum of income exceeds 1,500 euros per year. This limit will also be taken into account when compensatory pensions from the spouse or annuities for non-exempt alimony are received or when the payer of work income is not obliged to withhold. Nor will those who have received income less than 12,643 euros have to submit the declaration when they receive full income from work subject to a fixed withholding rate.

The Treasury does not forgive forgetfulness, and warns

One of the points on which Jesús Gascón, general director of the Tax Agency, has placed more emphasis this year is a notice system to warn taxpayers that the Administration has data on some aspects that they may not be declaring. This is the case of rentals or assets abroad.

Therefore, the Treasury will intensify control over these aspects. Gascón announced that the Agency plans to expand the messages for rental homes to 700,000 and the notifications for accounts abroad to 2.17 million. It will also begin sending messages, about 14,700, to taxpayers with operations with bitcoins or cryptocurrencies.

As for the draft, the Tax Agency no longer sends it on paper to homes as it did in the past. Now it offers it automatically for those taxpayers who access their platforms (website or Application) through the CL@VE PIN system, electronic DNI or Digital Certificate or with the reference number. But the Treasury remembers that it will only offer the draft for taxpayers for whom it has all the data. For those who have income from economic or professional activities (the self-employed and professionals) you will not be able to offer the draft.

It must also be taken into account that the draft is only a proposal from the administration, and that it may contain errors or omissions due to data that is not updated or other data that the taxpayer has to incorporate, so it is advisable to review it or put it in hands of professionals who can advise you.

Some typical cases that recommend this review are the following: Properties and their cadastral references, personal and family circumstances (if during 2018 you got married, separated, a family member died or you had children), property leases, transfers, or contributions to life plans. pensions, for example. It is also advisable to review union or political party dues, subsidies received, family and maternity deductions, deductions for investment in primary residence and, above all, regional deductions.
