The new Self-Employed Workers Act establishes a bonus for the permanent hiring of family members and improves existing bonuses for disabled people.

Bonuses for permanent contracts of family members

The recently approved Law for the Self-Employed introduces a new bonus of 100% of the employer's contribution for common contingencies for 12 months for those indefinite contracts signed by the self-employed worker with his/her spouse, ascendants, descendants and other relatives by consanguinity or affinity, up to the second degree inclusive, as employees.

The requirements are not to have terminated employment contracts for objective reasons, for disciplinary dismissals declared judicially unfair, or for collective dismissals declared not in accordance with the law, in the 12 months prior to the signing of the contract, and to maintain the level of employment in the 6 months following the signing of the contract, without valid and fair terminations being taken into account for these purposes.

Contribution benefits for people with disabilities, victims of gender violence and terrorism.

The benefits for contributions to persons with disabilities, victims of gender violence and victims of terrorism who establish themselves as self-employed workers are also improved, as regards the following:

– The period of withdrawal from this Special Regime required for such groups to be entitled to contribution benefits in the event of resuming a self-employed activity will be 3 years when they have already enjoyed them previously.

– If the effective date of registration in said Regime does not coincide with the first day of the calendar month, the benefit for that month will be applied proportionally to the days of registration.

– The reductions and bonuses will also apply to self-employed sea workers in Group 1, and to partners in labour companies and associated work cooperatives included in the Special Regime for Self-Employed Workers or in Group 1 for Sea Workers.

This measure will come into force on 1 January 2018.
