A few days before the deadline for submitting the income statements for the 2018 financial year, it is convenient to know the sanctions that the taxpayer faces if he does not comply with them.
Next Wednesday, June 26th, the term to present the 2018 income statement ends if you have result to enter and domicile is wantedr, according to the calendar published by the Tax Agency on its website.
Taxpayers whose personal income tax settlement has result to return or do not want to domicile income may present their declaration until the 1st of July, which is the last day of the campaign.
From the beginning of the campaign on April 1 and until June 11, the Tax Agency had returned 5,296 million euros to 8.15 million taxpayers.
All natural persons residing in Spain are obliged to present their declaration except in the following cases:
- Income from personal work equal to or less than 22,000 euros per year
- Income from movable capital and capital gains subject to withholding or payment on account, with a joint limit of 1,600 euros per year.
- Under no circumstances will those who obtain full income from work, capital or economic activities, or capital gains that jointly do not exceed 1,000 euros or who have exclusively suffered capital losses of less than 500 euros.
In case of not complying with the term established to present the Income Statement, in those cases that go out to pay, a surcharge will have to be paid that varies according to the times and can go between 5 and 20%.
If the declarant presents his exercise in the three months after the term, the surcharge will be of a 5%. This percentage will increase to 10% In the next three to six months, a 15% from six to twelve months and a 20% plus late-payment interest if more than a year has passed.
In the event that the result of the Income Statement is returned, the penalty for the delay in filing is 100 euros.
In those cases in which the Administration has notified the user of the delay, if the return is paid, the taxpayer will have to pay a fine that can range from 50% until the 150% of the corresponding amount in addition to interest.
In those cases in which the result is negative, a surcharge of 200 euros.
